Disability Discrimination?

Summary:

A lawsuit by a former central oregon hospital nurse manager alleging discrimination on account of a job related disability was rejected on all counts by the jury in Eugene’s U.S. District Court.

According to court documents, the nurse manager was diagnosed with post-traumatic stress during her 6 years at the hospital and claimed her supervisors harassed her, reduced her job responsibilities and exacerbated her stress level because of her disability.

The hospital responded to her requests for accommodation, including moving her office twice, and providing a secretary and support person.

She voluntarily quit in 2003 and went on long-term social security disability. She sought $825,000 from the hospital for loss of income, retirement benefits and emotional damages in her lawsuit.

The jury agreed she had a disability, but said she did not prove the hospital failed to provide her with reasonable accommodation, harassed her or breached confidentiality of her medical condition.
